Student team representing the University of Mannheim in the Willem C. Vis Moot receives Honorable Mentions in Hong Kong and Vienna

The team of eight law students that represented the University of Mannheim in the 13th Willem C. Vis (East) International Commercial Arbitration Moot in Hong Kong and in the 23rd Willem C. Vis International Commercial Arbitration Moot in Vienna has in both competitions received an Honorable Mention for its memorandum for the Claimant.


Mannheim's team has the following members: Juliana Christ, David van Koppen, Martin Dell, Daniel Skiebe, Nicole Lucks, Jonas Kiehl, Carolin Kemper and Michael Hohl. The team was coached by Sebastian Seidel and Professor Ulrich Schroeter.

Seminar FSS 2016:„Auf dem Weg zur Europäischen Kapitalmarktunion“

Im Frühjahrs-/Sommersemester 2016 wird Professor Schroeter zum genannten Oberthema ein Seminar im Schwerpunktbereich Kapitalmarktrecht (Wahlbereich 2) anbieten. Die Anmeldung ist bereits ab sofort per E-Mail (siehe unten) möglich; die Teilnehmerzahl ist auf zehn begrenzt. 

Verfahren: 
Die Themenvergabe kann nach Wunsch des einzelnen Seminarteilnehmers ab dem 5.10.2015 erfolgen. Themen werden immer montags ab 10.00 Uhr im Sekretariat des Lehrstuhls ausgegeben. Jeder zum Seminar zugelassene Seminarteilnehmer kann frei wählen, an welchem Montag er sein Thema erhalten und mit dessen Bearbeitung beginnen möchte. Der gewünschte Bearbeitungsbeginn ist dem Lehrstuhl mindestens eine Woche vorher mitzuteilen.

Die Seminarveranstaltung, auf der die mündlichen Seminarvorträge gehalten werden, wird voraussichtlich Ende Mai 2016 stattfinden.

Certificate Program on International Sales Law at Istanbul Bilgi University

On 16-18 September 2015, Professor Schroeter taught at Istanbul Bilgi University (Turkey) as part of its well-known Certificate Program on International Sales Law.

On 4 September 2015, Professor Schroeter presented a paper on consumer protection in e-commerce under EU private international law as part of the Journal of Private International Law Conference 2015 held at the University of Cambridge.

The paper (written in German) has now been published in the journal Wertpapier-Mitteilungen IV - Zeitschrift für Wirtschafts- und Bankrecht (WM) 2014, 1163-1172.

It discusses the requirements of prospectus disclosure in case of publicly offered participation rights (Genussscheine) with a particular focus on the obligation to disclose past involvements in supervisory proceedings, an issue that has arisen in connection with the recent insolvency of the German company PROKON.

The paper (written in German) has now been published in the Festschrift (liber amicorum) for Professor Ulrich Magnus on occasion of his 70th birthday (edited by Peter Mankowski and Wolfgang Wurmnest), Munich: Sellier. European Law Publishers (2014), 301-318.

It deals with party declarations under the UN Sales Convention (CISG) that are made subject to conditions precedent or conditions subsequent and suggests that such conditions should be treated in accordance with the "general principles" on which the Convention is based.

In the past 15 months or so, the Austrian, the Swiss and the German Supreme Court have each cited Professor Schroeter’s scholarly writings on the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG) in their decisions:

The Austrian Supreme Court (Oberster Gerichtshof) in its judgment of 13 December 2012 (docket no. 1 Ob 215/12 t) made numerous references to Professor Schroeter’s commentary on Article 18 CISG in the 5th edition of the German Schlechtriem/Schwenzer Kommentar zum Einheitlichen UN-Kaufrecht (CISG) published in 2008 in deciding upon a dispute between a Romanian seller and an Austrian buyer of isolation material.

In its judgment of 23 September 2013 (docket no. 4A_264/2013), the Swiss Federal Supreme Court (Bundesgericht) similarly cited Professor Schroeter’s commentary on Article 25 CISG in the above-mentioned Kommentar when dealing with the avoidance of a Swiss-Italian contract for the sale of wire rod (value: 7,350,000 USD).

And finally the German Supreme Court (Bundesgerichtshof) in its decision of 7 January 2014 (docket no. VIII ZR 137/13) referred to Professor Schroeter’s commentary on Article 21 CISG in the recently published 6th edition of the Kommentar when deciding whether an Italian and a German party had agreed on a forum selection clause in their contract for the sale of printed books concluded via an exchange of e-mails.

Professor Schroeter elected Member of the CISG Advisory Council

At its 18th meeting in Beijing (China) in October 2013, the CISG Advisory Council (CISG-AC) has elected Professor Schroeter as a new Member.

The CISG Advisory Council is a private association of Professors of international trade law which aims at promoting a uniform interpretation of the United Nations Convention on Contracts for the International Sale of Goods (CISG). It does so by adopting and publishing Opinions on questions of interpretation that have arisen under the Convention.

The CISG-AC was established in 2001 in Paris. Its current Members are Professor Ingeborg Schwenzer (University of Basel, Switzerland) (Chair), Professor Yesim M. Atamer (Istanbul Bilgi University, Turkey), Professor Eric E. Bergsten (Pace University School of Law, U.S.A.), Professor Michael Joachim Bonell (University of Rome La Sapienza, Italy), Professor Michael G. Bridge (London School of Economics, United Kingdom and National University of Singapore), Professor Alejandro M. Garro (Columbia University School of Law, U.S.A.), Professor Sir Roy M. ESC Research Award 2013 for Ulrich Schroeter

The Esche Schümann Commichau Foundation, Hamburg, has bestowed a research award on Professor Schroeter in recognition of his post-doctoral thesis on the law of credit rating agencies. The award ceremony was held in Hamburg on 19 April 2013. 

The ESC Foundation is twice yearly giving research awards for doctoral theses, post-doctoral theses and diloma theses written in the areas of law or economics. The award recipients are chosen by the foundation's curatorium which consists of Prof. Dr. Dr. h.c. Klaus Brockhoff, Dr. Ernst-August Ehlers, Prof. Dr. Heinrich Wilhelm Kruse and Prof. Dr. Dres. h.c. Karsten Schmidt.

Stiftungs-Förderpreis 2012

Professor Schroeter has recently been awarded the Stiftungs-Förderpreis 2012 of the Foundation Capital Markets Law for the Financial Centre Germany (Stiftung Kapitalmarktrecht für den Finanzstandort Deutschland). The Foundation was established by the KfW Banking Group, an entity owned by the German Federal Government, and is giving its annual Research Award in recognition of outstanding research conducted on matters relating to the financial markets,to  financial market regulation and to securitization. The Award was presented to Professor Schroeter on 19 September 2012 in Berlin.

DAI Research Award

Ulrich Schroeter receives the German Share Institute's Hochschulpreis 2011

Ulrich Schroeter has been awarded the prestigious  Hochschulpreis 2011 for his recent comparative law treatise on the regulation of credit rating agencies. The Hochschulpreis is a research award given annually by the German Share Institute (Deutsches Aktieninstitut) for outstanding research in the areas of economics and law relating to the financial markets. The award was present to Dr. Schroeter during a ceremony at the Frankfurt Stock Exchange on 25 April 2012. For further details, see the press release (in German).
